- Immediately after Federal Supreme Court President Dias Toffoli’s decision, tonight (December 19th), to revoke Supreme Court Minister Aurélio Mello’s injunction which would suspend imprisonment for people whose appeals processes are still underway, former President Luiz Inácio Lula da Silva’s defense team filed a motion for his release. - Parliamentarians protested the decision of judge Carolina Lebbos, of the 12th Federal Court in Curitiba, to not accept Federal Supreme Court Minister Marco Aurelio’s injunction to suspend imprisonment for defendants before their appeals processes are exhausted, which would benefit former President Lula. In addition to ignoring the injunction, the judge consulted with the Public Prosecutors office as if it had jurisdiction over the Supreme Court. PT President Gleisi Hoffman said that the judge insulted the Supreme Court, and PT Congressional leader, Paulo Pimenta (Rio Grande do Sul) classified Lebbos’ decision as an “insult to the rule of law,” because she was supposed to obey and not ignore the Federal Supreme Court Minister’s injunction.
- While the decision of Minister Marco Aurélio Mello was valid, ex-President Lula’s defense team filed a motion for his immediate release. For the former President’s lawyer, Cristiano Zanin, the decision of the Federal Supreme Court Minister was made to to restore the principle of the presumption of innocence enshrined in the Constitution. - Renowned lawyers and legal scholars applauded Marco Aurélio Mello’s decision which was later revoked in a dubious manner by Supreme Court President Dias Toffoli. “The decision was correct according to the Constitution, the minister did what he was supposed to do, in terms of obeying the Constitution,” said the legal scholar and Constitutional Law Professor Pedro Serrano. The criminal lawyer José Roberto Batocchio, from Lula’s defense team, also praised Mello. “We finally found a Supreme Court Justice who obeys the Constitution,” he said, “unlike the others.”
- The good night shout to former President Lula echoed strongly on this Wednesday in front of the Federal Police headquarters in Curitiba. Over 500 people yelled to him, all with the hope that he would be freed. Luiz Carlos dos Santos, the director of the APP Union, which represents public school teachers in the Paraná state education system, was one of the leaders of the demonstration. He highlighted the importance of freedom for Lula, who has been a political prisoner for over 8 months.
